Ratio Decidendi

The court held that the dispute concerned the transfer of management and implementation of a government project between agencies within the same ministry, and did not fall within the jurisdiction conferred upon the Environment and Land Court by Article 162(2)(b) of the Constitution or the Environment and Land Court Act. The court found that it lacked jurisdiction to entertain the application. Furthermore, the question of the applicant's capacity to sue was rendered moot by the lack of jurisdiction. Consequently, the preliminary objection was upheld and the judicial review application was struck out. Each party was ordered to bear its own costs.
