The Applicant was therefore entitled in law to lodge a fresh appeal. The Tribunal further held that the Applicant had advanced a reasonable ground for delay—namely, the negligent conduct of its tax agents in failing to file the necessary documents, which led to the striking out of the previous appeal. The Tribunal accepted that such mistakes should not be visited on the Applicant and that the delay was not inordinate.
