Ratio Decidendi

The court found that although there had been a prolonged delay in prosecuting the appeal, the delay was reasonably explained by ongoing negotiations between the parties, which had resulted in part settlement of related matters. The court held that such negotiations provided sufficient excuse for the delay and, therefore, declined to dismiss the appeal for want of prosecution. However, the court directed that the appeal be either settled or fixed for hearing within six months, failing which it would stand dismissed with costs to the respondent.
