It accepted that the respondent, as a public school operating under strict budgetary provisions, would suffer substantial loss if execution proceeded before the appeal was determined. The court held that the Kshs. 400,000 already paid was insufficient as security for the full judgment sum. To balance the interests of both parties, the court ordered the applicant to pay a further Kshs. 400,000 by 1.10.2015 and to file a scheme of arrangement for payment of the outstanding judgment sum in the next budget cycle, should the appeal fail.
