Procedural Posture

Criminal Appeal / Judgment on Appeal

  1. 1 Whether the conviction of the appellants for stock theft was supported by evidence beyond reasonable doubt.
  2. 2 Whether the doctrine of recent possession applied to the appellants.
  3. 3 Whether the sentence imposed was excessive in the circumstances.

Ratio Decidendi

The appellants were found in possession of the stolen cow the morning after it was stolen, claimed ownership falsely, and admitted possession. Although not seen stealing, the proximity in time and their possession of the cow invoked the doctrine of recent possession, justifying the inference that they were the thieves. Their admissions in unsworn statements further corroborated the prosecution's case. The trial court's conviction was therefore supported by evidence beyond reasonable doubt. The sentence imposed, being half the statutory maximum, was not excessive given the circumstances, including recovery of the cow and the appellants' admissions.
