Procedural Posture

Miscellaneous Application / Ruling on Notice of Motion Dated 17th November 2008

  1. 1 Whether the objector is entitled to monthly maintenance from funds deposited in court for the upkeep of the subject and his family.
  2. 2 Whether the objector has an independent source of income sufficient to meet the needs claimed.
  3. 3 Whether the petitioner has failed in his duty to provide maintenance and medical care for the subject.

Ratio Decidendi

The court found that the objector failed to establish a lack of independent income, as evidence showed she was receiving rental income from Everest Enterprise Limited and had made substantial remittances to Michael Mwangi Muriuki in the U.S.A. The court also accepted the petitioner's uncontested assertion that he continued to purchase medicine for the subject, but was prevented from delivering it by the objector. Consequently, the objector's claim for monthly maintenance from the funds deposited in court was without basis, and the application was dismissed with costs to the petitioners.
