Procedural Posture

Civil Appeal / Application to Adduce Further Evidence on Appeal

  1. 1 Whether the applicant has satisfied the principles for adducing additional evidence on appeal under Rule 29 of the Court of Appeal Rules.
  2. 2 Whether the evidence sought to be adduced could not have been obtained with reasonable diligence for use at the trial.
  3. 3 Whether the additional evidence would have an important influence on the result of the appeal.

Ratio Decidendi

The court found that the applicant failed to satisfy the principles governing the admission of additional evidence on appeal. The evidence sought to be introduced was available at trial and could have been produced with reasonable diligence. Furthermore, the additional evidence, being a summary of information already before the trial court, would not have an important influence on the result of the appeal, especially in the absence of a cross-appeal on the calculation of commission. The court concluded that the application was misconceived and devoid of merit, and therefore dismissed it with costs.

Court Disposition

application dismissed with costs

Orders
