The High Court has jurisdiction, under its inherent powers and the Erinford Properties principle, to grant an injunction pending appeal even after refusing an earlier injunction application. This jurisdiction is not ousted by the fact that a similar application is pending before the Court of Appeal, provided the application is not an abuse of process.
