The court found that although the applicant delayed in seeking leave to file a reference against the taxing officer's decision, the delay was attributable to his former advocates' mistake. The court held that justice should not be denied due to procedural technicalities, especially where the applicant had made efforts to comply with the court's capped costs order. The court exercised its discretion to grant leave to file the reference out of time and ordered a stay of execution of the taxed costs, conditional upon the applicant depositing the capped sum of Kshs.300,000 into court within 21 days.
