The court found that while the plaintiff had not demonstrated sufficient diligence in prosecuting the suit, there was evidence of some effort to fix hearing dates, and the delay was partly attributable to the court diary being full. Given that the matter concerns land and the plaintiff claims to reside on the suit premises with his family, the court exercised its discretion not to dismiss the suit at this stage. However, the court warned that any further laxity by the plaintiff would result in the vacation of the injunctive orders. The application for dismissal was therefore declined in the interests of justice, but the plaintiff was cautioned to actively pursue the hearing of the case.
