Ratio Decidendi

The court found that although there was a delay of almost four months in filing the application for stay of execution and leave to appeal out of time, the applicants are currently in possession of the suit property and any execution may render the intended appeal nugatory. The applicants have demonstrated that they have nowhere else to go and that substantial loss would be suffered if the orders are not granted. The court was satisfied that the application was merited and allowed the stay of execution for six months and granted leave to appeal out of time, subject to payment of costs.
