The Court of Appeal held that the applicants failed to provide a cogent and plausible explanation for the inordinate twelve-year delay in seeking to file an appeal out of time. The court found that the reasons advanced, including illness and reliance on Kituo Cha Sheria, were insufficient and not supported by evidence as to when assistance was sought. The full bench reiterated that its role was not to substitute its discretion for that of the single judge, but only to interfere if the single judge acted on wrong principles or was plainly wrong. Finding no such error, the court declined to interfere with the single judge's decision and dismissed the reference.
