Ratio Decidendi

The court found that the Claimant's cause of action, based on alleged unlawful termination of employment, accrued on 30 September 2000. The applicable law, Section 4(1)(a) of the Limitation of Actions Act, required that such contractual claims be filed within six years. The Claimant filed suit on 15 March 2012, more than 11 years after the cause of action arose. Citing the Court of Appeal decision in Divecon v Samani, the court held that it had no jurisdiction to entertain a contract-based claim filed outside the statutory limitation period, and that there is no discretion to extend time for such actions. Consequently, the court struck out the claim as statute barred.
