The court found that while the applicant provided a valid explanation for his absence during his hospital admission, he failed to satisfactorily account for his whereabouts and efforts to comply with bail conditions on other dates. The applicant's attempts to contact his advocate were deemed insufficient, and his overall conduct did not reflect seriousness in attending to the matter. Nevertheless, considering the entire record and in the interest of justice, the court exercised discretion to grant the applicant a second chance by allowing him to be released on a new cash bail of KShs. 10,000, despite the regular forfeiture of the previous bail.
