Ratio Decidendi

The Principal Magistrate, Alex Anambo, had no jurisdiction to hear and determine the application dated 4th June, 2002 because it had already been dismissed by another magistrate and had not been reinstated. As a result, there was no valid application before the court on which to base the orders made on 17th September, 2002. The orders were therefore made in error and must be set aside. The appeal is allowed and the appellant is entitled to costs.
