Ratio Decidendi

The High Court lacks jurisdiction to resentence the applicant after his appeal was dismissed. The Supreme Court's decision in Francis Karioko Muruatetu, which declared mandatory death sentences unconstitutional, does not extend to mandatory sentences under the Sexual Offences Act for defilement. The only recourse available to the applicant, having exhausted his appeal at the High Court, is to pursue an appeal at the Court of Appeal. The High Court cannot review or resentence in these circumstances, as its supervisory powers do not apply to its own decisions, and the Constitution provides for appeal or review only by a higher court.
