Furthermore, the appellant did not file a record of appeal within the prescribed time or at all, contrary to the mandatory requirements of Order 42 Rule 13(4)(f) of the Civil Procedure Rules. The absence of a record of appeal and the lack of leave to file out of time rendered the appeal incompetent and deprived the court of jurisdiction to consider the merits.
