Ratio Decidendi

The court found that the Respondent failed to prove that the Claimants deserted duty, as no evidence was produced to show that the Claimants were notified of impending dismissal or that any valid reason for dismissal existed. The Respondent also failed to comply with the procedural fairness requirements under Section 41 of the Employment Act, 2007. Allegations of misconduct and poor performance were unsupported by evidence and appeared to be afterthoughts to justify the dismissals. Consequently, the court held that the Claimants were unlawfully and unfairly dismissed and entitled to compensation, notice pay, leave pay, and service pay.
