Ratio Decidendi

The court found that there were no sufficient grounds to review the previous order transferring the matter to the Eldoret Environment and Land Court. The judge noted that the suit properties are registered in Bungoma, but the distances between Bungoma and Eldoret, and Bungoma and Kakamega, are almost the same. The court held that the time spent on further transfer applications would be better used in progressing the hearing. The Environment and Land Court has unlimited territorial jurisdiction, and no significant inconvenience or prejudice would be occasioned to either party by proceeding in Eldoret. The application for review and transfer was therefore disallowed.
