Procedural Posture

Criminal Appeal / Judgment

  1. 1 Whether the mandatory minimum sentence under section 8(4) of the Sexual Offences Act is constitutional in light of recent jurisprudence.
  2. 2 Whether the sentence of 15 years' imprisonment imposed on the appellant was harsh and excessive given the circumstances.

Ratio Decidendi

The court held that, following the Supreme Court's decision in Muruatetu and the Court of Appeal's decision in Jared Koita Injiri, mandatory minimum sentences under section 8(4) of the Sexual Offences Act are unconstitutional, and sentencing discretion must be exercised based on the circumstances of each case. Considering the complainant was 16 years old, the appellant was 22, they had a prior relationship, and a child together, the court found the 15-year sentence harsh and excessive. The time already served in custody was deemed sufficient punishment, and the sentence was substituted with time served.
