Ratio Decidendi

The court found that although the Defendant is the registered proprietor of the suit land, his title is under challenge on grounds of alleged fraud. The Plaintiff provided documentary evidence supporting his claim and raised serious questions regarding the manner in which the Defendant acquired title. Given that the Plaintiff established a prima facie case and that the legal status of the land is in dispute, the court held that it is just and equitable to preserve the property by restraining the Defendant from dealing with it pending the determination of the suit. The court limited the injunction to one year, subject to further orders, and directed that costs be in the cause.
