It does not extend to staying proceedings before a different court, even if those proceedings gave rise to the constitutional petition. Once an informal application for stay under Rule 33 has been made and rejected, the High Court is functus officio and cannot entertain a subsequent formal application for stay. The applicant's recourse lies with the appellate court. The court further found that the criminal process is a constitutional and legal process and does not amount to irreparable loss....
