Miscellaneous Application / Ruling on Interlocutory Application

  1. 1 Whether the court should grant a temporary injunction restraining the Registrar of Trade Unions from effecting changes in the register of officials of the Kenya Shipping, Clearing and Warehouses Workers Union pending determination of the suit.
  2. 2 Whether the purported removals and changes of union officials between 15th May, 2011 and 23rd August, 2011 were unlawful and contrary to the union's constitution.
  3. 3 Whether the multiple related cases filed by the applicants constitute an abuse of court process.

Ratio Decidendi

The court declined to grant the injunctive and other interim reliefs sought by the applicants on the basis that the filing of multiple related cases by the same parties concerning the same subject matter constitutes an abuse of the court process. The court found that the applicants had filed duplicative applications and causes, thereby clogging the court process. As a result, the court ordered that all three related causes be placed before the Principal Judge for consolidation and further directions, rather than granting any substantive orders in the present application.

Court Disposition

application dismissed; related causes to be consolidated

Orders

  • All three related causes (Cause Nos. 1471/2011, 1438/2011, and 1986/2011) to be placed before the Principal Judge on 19th November, 2012 for consolidation and further directions.
  • No orders granted in relation to the present application.
