Ratio Decidendi

The court found that the Commissioner for Co-operative Development acted in excess of his statutory powers by issuing surcharge orders against the applicants following an inquiry conducted under Section 58 of the Co-operative Societies Act. Section 58 only allows for inquiries into the general affairs of a society and does not provide for surcharging individuals. Surcharging can only be done under Section 73, which requires an inquiry into the conduct of specific individuals and affords them the right to be heard. The applicants were not given an opportunity to defend themselves, violating the principles of natural justice. Therefore, the surcharge orders were issued without legal basis...
