However, it was clear that the Claimants were not subjected to any procedure prior to termination, and the Respondent failed to comply with statutory requirements for redundancy under Section 40 of the Employment Act. The Respondent also failed to prove that salaries were consolidated to include house allowance or that the 2nd Claimant was on probation.
