Legal Issues
- 1 Whether the appellant should be granted an adjournment to file a supplementary memorandum of appeal.
- 2 Whether the interests of justice require allowing the appellant additional time to clarify his grounds of appeal.
Ratio Decidendi
The Court of Appeal determined that, given the gravity of the sentence (death) and the inadequacy of the original memorandum of appeal prepared by the appellant in person, it was in the interests of justice to grant an adjournment. The court exercised its discretion to allow counsel for the appellant to file a supplementary memorandum of appeal, ensuring that the appellant's case is properly presented and that his right to a fair hearing is preserved. The adjournment was granted to avoid prejudice to the appellant and to facilitate a just determination of the appeal.
Court Disposition
Application for adjournment granted; leave given to file supplementary memorandum of appeal within 14 days; appeal adjourned.
Orders
- Leave is granted to Mrs Field-Marsham to prepare and file a supplementary memorandum of appeal within 14 days.
- The appeal stands adjourned to a date to be fixed.
