The court found that the preliminary objection was premature as it was not anchored on any defence or pleading and involved factual disputes that required ascertainment at a full hearing. On the application for interlocutory injunction, the court held that the Plaintiff failed to establish a prima facie case, as there was no evidence of subdivision or issuance of compensation awards, and the Plaintiff, along with some Defendants, were confirmed as lawful proprietors of the suit land. Consequently, the Plaintiff was not entitled to restrain co-proprietors from dealing with the land. Both the Notice of Motion and the Preliminary Objection were found unmerited and disallowed.
