Procedural Posture

Notice of Motion / Ruling on Post Judgment Eviction Application

  1. 1 Whether the applicant is entitled to eviction orders against the respondent from land parcel MAKUYU/MAKUYU BLOCK II/1263.
  2. 2 Whether the court should enforce its previous judgment by issuing orders for eviction and police assistance.

Ratio Decidendi

The court found that the applicant, as the decree holder, is entitled to execution of the judgment delivered on 31/5/2018 and subsequent orders of 13/12/2018, which required the respondent to vacate the suit land within sixty days. The respondent failed to comply and did not oppose the application for eviction. The court held that it is within its mandate to enforce its orders and ensure the applicant enjoys the fruits of judgment. Accordingly, the court allowed the application for eviction, authorized HIPPO Auctioneers to execute the order, and directed the police to provide security during the eviction.

Court Disposition
