The trial magistrate imposed a fine of Kshs 10,000 for the offence of gambling in a public place, contrary to section 55(1) of the Betting, Lotteries and Gaming Act, which prescribes a maximum fine of Kshs 3,000. This sentence was illegal and excessive, occasioning a miscarriage of justice. The High Court, exercising its supervisory and revisional jurisdiction, quashed the illegal sentence and substituted it with the lawful maximum fine. Regarding forfeiture, the trial court failed to comply with the mandatory procedural requirements under section 67 of the Act and section 389A of the Criminal Procedure Code, including giving notice and conducting an inquiry into third-party interests....
