Ratio Decidendi

The court found that although the plaintiff is the registered owner of the suit property, the evidence did not establish trespass by the defendant. The testimony of the County Physical Planner indicated that the Part Development Plan had not been followed, all plots from X to Q had shifted, and a new plan had been adopted by the community. The new plan was not produced in evidence, and no surveyor clarified the actual position of the plots on the ground. Given the lack of conclusive evidence and the shifting of boundaries, the court held that trespass was not proved on a balance of probabilities. Consequently, the plaintiff's case failed.
