Procedural Posture
Criminal Petition / Preliminary Directions; Awaiting Records From Lower Courts
Legal Issues
- 1 Whether the court can proceed to determine the petition without records from the lower courts.
- 2 What directions should be given regarding the substance of the petition.
Ratio Decidendi
The court cannot proceed to give directions on the substance of the petition until it has had the opportunity to review the records from Kakamega HCCRC No. 245 of 2002 and Kisumu CACRA No. 387 of 2012. The Deputy Registrar is therefore directed to avail these records, after which the court will issue further directions. This approach ensures that the court acts on a complete factual and procedural basis, upholding the principles of fair hearing and due process.
Court Disposition
Directions deferred pending availing of records.
