The High Court held that under section 28(5) of the Limitation of Actions Act, leave to file suit out of time must be obtained from the court in which the suit is intended to be filed. The plaintiff, having obtained leave from the subordinate court, was required to file the main suit in that court, not in the High Court. The leave obtained from the subordinate court was therefore inapplicable to the suit filed in the High Court. The court further held that the proper procedure is for the plaintiff to seek leave in the High Court itself, and only upon such leave being granted can the suit proceed.
