The applicant did not challenge the conditional stay as onerous before the lower court nor seek its review. The Court held that, in these circumstances, the applicant was not entitled to further discretionary relief under Rule 5(2)(b) of the Court of Appeal Rules, as she had participated in and partially complied with the consent order. The application for stay was therefore dismissed.
