Ratio Decidendi

However, the plaintiff's suit for recovery of land was also found to be time barred under Section 7 of the Limitation of Actions Act, as it was filed more than twelve years after the agreement became void and after the defendant took possession. The court held that the defence of limitation was available to the defendant and dismissed the suit. The court declined to make any pronouncement on adverse possession as no counterclaim was filed by the defendant.
