Procedural Posture

Notice of Motion / Ruling on Interlocutory Injunction Application

  1. 1 Whether the plaintiffs have established a prima facie case to warrant the grant of a temporary injunction restraining the defendant from evicting them from plot No. 4 at Njoro Ndirangu/Kariombangi Estate.
  2. 2 Whether the plaintiffs have demonstrated irreparable injury that cannot be compensated by damages.
  3. 3 Whether the balance of convenience tilts in favour of granting the injunction.

Ratio Decidendi

The plaintiffs failed to establish a prima facie case as they did not provide sufficient evidence to prove their relationship to the defendant or the validity of the agreement permitting them to stay on the suit property. The burden of proof rested on the plaintiffs, and their failure to file a supplementary affidavit or provide documentary evidence such as birth certificates undermined their claim. Consequently, the court was not persuaded that the plaintiffs had any legal basis to restrain the defendant from obtaining vacant possession of his land. Without a prima facie case, the other considerations for granting an injunction—irreparable injury and balance of convenience—did not arise.
