The court was satisfied that the applicants had provided a reasonable explanation for the delay, namely the late supply of the typed judgment. Applying the principles governing extension of time, the court exercised its discretion in favour of the applicants and granted leave to file the appeal out of time, subject to the condition that the appeal be filed within 14 days from the date of the judgment. The court also ordered the applicants to bear the costs of the miscellaneous suit.
