The court found that the deceased had made clear arrangements for the distribution of his estate, providing L.R. No. Aguthi/Gaki/648 to the house of Mary Wanjiru Kimini (the Protestor's mother) and intending L.R. No. Aguthi/Gaki/653 to be inherited by the houses of Waihuini Kimini and Njunga Kimini. The evidence, including affidavits and proceedings from a panel of elders, supported the conclusion that the house of Mary Wanjiru Kimini had already been sufficiently provided for and should not benefit further from L.R.
