Ratio Decidendi

The court held that it lacked jurisdiction to grant a temporary injunction post-judgment under Order 40 of the Civil Procedure Rules, as its jurisdiction is limited to the period before final judgment. Once judgment is rendered, only the Court of Appeal has jurisdiction to grant such relief under Rule 5(2)(b) of the Court of Appeal Rules. Furthermore, since there was no pending appeal and only an application for enlargement of time to appeal was before the Court of Appeal, the trial court could not grant the orders sought. The application was therefore declined for want of jurisdiction and absence of a pending appeal.
