The Tribunal found that the Respondent, in its Statement of Defence, admitted the Claimant's deposit of Kshs.163,000, which constituted a clear and unequivocal admission. The Tribunal exercised its discretion to grant judgment on admission, as the facts were not in dispute and no complex legal interpretation was required. The Tribunal also held that the Replying Affidavit, though not commissioned, should be considered in the interest of substantive justice and not technicalities, in line with Article 159(2)(d) of the Constitution.
