The Court held that it has jurisdiction under section 73(1) of the Land Registration Act to order removal of a caution, even if the removal was not specifically pleaded in the original suit, provided the parties were before the Court and their rights have been fully determined. The doctrine of functus officio does not preclude the Court from granting such an order in these circumstances. The Court found that the Defendant was adjudged the rightful owner of the suit land and that there was no pending appeal or stay of judgment.
