The court found that after the expiry of the lease in 1979, the Defendant remained in occupation without consent and without payment or acceptance of rent, making him a tenant at sufferance and, in effect, a trespasser. The Defendant's own admissions and conduct demonstrated recognition of the Plaintiffs' ownership, defeating his claim of adverse possession.
