Ratio Decidendi

The court found that the applicant, Justus Nyongesa, had obtained a limited grant ad litem and was therefore properly substituted in place of the deceased 1st defendant, Nyongesa Onyimbo. However, the plaintiffs/applicants failed to establish the requisite principles for the grant of an interlocutory injunction as set out in Giella v Cassman Brown & Co. Ltd. Specifically, they did not demonstrate a prima facie case with a probability of success, nor did they show that they would suffer irreparable harm that could not be compensated by damages. Consequently, the court granted the prayer for substitution but dismissed the prayers for temporary injunction. Costs were ordered to be in the cause.
