The applicant did not demonstrate that she diligently pursued the appeal or followed up with her counsel or the court registry. The failure to serve the request for proceedings on the respondent meant the applicant could not benefit from the exclusion of time under Rule 82. The court also found that the intended appeal had little prospect of success and that the respondent would suffer prejudice due to the prolonged delay.
