Procedural Posture

Succession Cause / Ruling on Application for Revocation of Grant

  1. 1 Whether the grant of letters of administration was obtained without notifying all entitled parties.
  2. 2 Whether there was non-disclosure of all estate properties and beneficiaries by the petitioner.
  3. 3 Whether the petitioner unfairly distributed the estate.

Ratio Decidendi

The court found that the applicant failed to provide documentary evidence that the omitted properties belonged to the deceased or to name any other beneficiaries allegedly left out. The applicant also did not provide evidence of his relationship to the deceased. However, the court noted procedural lapses and, in the interest of justice, exercised its powers to allow further inquiry. The court ordered the chief who authored the relevant letter to appear and directed the applicant to provide land registry records to substantiate his claims. The court deferred determination of the revocation application pending receipt of this information.

Court Disposition

Further inquiry ordered; determination of revocation application deferred.
