Although the plaintiff was not an eyewitness and did not call direct evidence as to how the accident occurred, the defendant, who was in a position to explain the circumstances of the accident, failed to adduce any evidence or rebut the plaintiff's case. Applying Section 112 of the Evidence Act and the Court of Appeal's reasoning in Rahab Micere Murage v Attorney General & 2 Others, the court found that the cause of the accident was a matter especially within the defendant's knowledge. The defendant's failure to testify or provide evidence as to how the accident occurred led to a rebuttable presumption of negligence on his part.
