Ratio Decidendi

The court found that the plaintiff's registration as proprietor of the suit land was not done procedurally or lawfully, as she had not obtained a grant of letters of administration for the estate of the deceased original owner, Kipsoi Arap Bargak. Section 45 of the Law of Succession Act prohibits intermeddling with the estate of a deceased person without such a grant. Although the defendant alleged fraud, he did not prove it to the required standard, nor did he have a better claim, as his occupation was also contrary to the law. Both the plaintiff and interested party, as grandchildren of the deceased, must obtain letters of administration before their interests can crystallize....
