Procedural Posture

Succession Cause / Ruling on Preliminary Objection to Chamber Summons Seeking to Set Aside Taxation Order

  1. 1 Whether the respondent's chamber summons dated 12th July 2007 is barred by the doctrine of res judicata.
  2. 2 Whether the application seeks to set aside orders already determined in a previous application.

Ratio Decidendi

The court found that both the application dated 29th May 2007 and the chamber summons dated 12th July 2007 sought to set aside the same taxation order on identical grounds, namely the absence of a court order for costs. The doctrine of res judicata applies not only to issues actually decided but also to those that could have been raised in the earlier application. Since the respondent had already litigated the issue in the previous application, the current application was barred by res judicata. The court dismissed the chamber summons with costs to the applicant.

Court Disposition

Application dismissed as res judicata.

Orders

  • The chamber summons dated 12th July 2007 is dismissed.
  • Costs awarded to the applicant.
