The respondent failed to produce evidence of lawful termination or expiry of contract and did not follow due process as required by law. The claimant was only paid up to July 2015, leaving salary arrears for August to October 2015. The court held that the contract was terminated before its due date without procedural fairness, entitling the claimant to salary arrears for the unexpired period and compensation for unfair termination. The total award was Kshs. 108,000 plus costs and interest.
