The court found that although the applicant had deposited the sum required by the consent judgment, there was a subsequent agreement dated 4.9.2010, signed before an advocate, in which the applicant undertook to pay the respondent KShs.50,000 before the title deed would be released. The applicant did not dispute the validity of this agreement or demonstrate compliance with its terms. As such, the applicant had not fulfilled all obligations necessary to entitle him to the order sought. The application was therefore premature and could not be granted until the applicant complied with the agreement of 4.9.2010.
