JUDGMENT
I am satisfied that the Notice of Motion dated 7th June 2012 is merited as it is not opposed. In the circumstances, an order of mandamus is issued against the respondent, the City Council of Nairobi or its successor in law, to pay the applicant the sum of Kshs.352,960/= being the decretal sum and certified costs as at 8th March 2007 and accrued interest at 12% per annum until payment in full arising from the judgment in Milimani PMCC No. 5272 of 2004 (Jared Onyango Ominde v Nairobi City Council).The respondent shall bear the costs of the application.
